Welcome to IMPACKED. These Terms of Service ("Terms") govern your access to and use of the IMPACKED website, products and services. By accessing our website or placing an order with us, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.


1. About IMPACKED

IMPACKED provides custom packaging solutions, including printed flexible packaging, pouches, coffee bags, labels, cartons, cups and related packaging products for businesses in Australia and internationally.


2. Acceptance of Orders

Orders are accepted once:

  • A quotation has been approved.
  • Artwork has been approved where applicable.
  • Any required deposit has been received.
  • IMPACKED confirms acceptance of the order.

We reserve the right to decline or cancel any order at our discretion before production commences.


3. Quotations

Unless otherwise stated, quotations remain valid for 30 days from the date of issue.

Pricing is based on the specifications provided at the time of quotation. Any changes to product specifications, artwork, quantities or shipping requirements may result in revised pricing.


4. Custom Manufactured Products

Most products supplied by IMPACKED are custom manufactured specifically for each customer.

Once production has commenced, custom orders cannot be cancelled or modified without our written approval.

Because custom products are manufactured exclusively for the customer, they cannot be returned due to change of mind.


5. Artwork Approval

Customers are responsible for carefully reviewing all artwork before approving production.

Artwork approval confirms that the customer accepts responsibility for:

  • Spelling and grammar
  • Colours
  • Dimensions
  • Layout and positioning
  • Barcodes
  • Regulatory information
  • Ingredients and nutritional information
  • All other printed content

IMPACKED is not responsible for errors contained within artwork approved by the customer.


6. Colour Variation

Printed colours may vary slightly from digital artwork, printed proofs or previous production runs due to differences in materials, inks, printing processes and viewing conditions.

Minor colour variation is considered normal within commercial printing and does not constitute a defect.


7. Manufacturing Tolerances

Commercial packaging manufacturing involves standard production tolerances.

Reasonable variations in dimensions, print registration, sealing, material appearance and finish are considered acceptable industry practice.


8. Under & Over Deliveries

Production quantities may vary by up to 10% under or over the ordered quantity.

The final invoice will be adjusted to reflect the actual quantity supplied.


9. Production & Delivery Timeframes

Estimated production and delivery timeframes are provided in good faith but are estimates only.

Production or delivery may be affected by circumstances including:

  • Material availability
  • Manufacturing schedules
  • Shipping delays
  • Customs processing
  • Weather events
  • Public holidays
  • Industrial action
  • Events beyond our reasonable control

IMPACKED is not liable for losses resulting from production or delivery delays.


10. Shipping

Risk in the goods passes to the customer upon delivery to the nominated delivery address or collection by the nominated carrier.

Customers are responsible for ensuring delivery details are accurate.

Additional freight charges resulting from incorrect delivery information or failed delivery attempts may be charged to the customer.


11. Payments

Payment terms are specified on the quotation or invoice.

Unless otherwise agreed:

  • Deposits must be paid before production begins.
  • Outstanding balances must be paid prior to dispatch.

Late payments may result in delayed production or shipment and may incur interest or recovery costs where permitted by law.


12. Retention of Title

Ownership of all goods remains with IMPACKED until payment has been received in full.

Until ownership transfers, customers must not sell, dispose of or otherwise deal with unpaid goods in a manner inconsistent with IMPACKED's ownership rights.


13. Customer Artwork & Intellectual Property

Customers warrant that they own or have permission to use all artwork, logos, trademarks and other intellectual property supplied to IMPACKED.

Customers indemnify IMPACKED against any claims arising from infringement of third-party intellectual property rights.


14. Product Suitability

Customers are responsible for ensuring that the packaging selected is suitable for their intended application, including compatibility with the product being packaged, storage conditions, transport requirements and shelf-life expectations.

Where required, customers should conduct their own filling and sealing trials before commercial use.


15. Limitation of Liability

To the maximum extent permitted by law, IMPACKED is not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, business opportunities or goodwill arising from the supply or use of our products or services.

Where liability cannot be excluded by law, IMPACKED's liability is limited, at its option, to:

  • Repairing the goods;
  • Replacing the goods; or
  • Refunding the purchase price of the affected goods.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.

Any guarantees or warranties implied by law continue to apply where required.


17. Website Use

Users agree not to:

  • Use the website for unlawful purposes.
  • Attempt to gain unauthorised access to our systems.
  • Interfere with the operation or security of the website.
  • Upload malicious software or harmful code.
  • Infringe the intellectual property rights of IMPACKED or others.

We reserve the right to restrict or terminate access where misuse is identified.


18. Intellectual Property

Unless otherwise stated, all website content, including text, graphics, photographs, designs, branding, layouts and marketing materials, remains the property of IMPACKED or its licensors.

No content may be copied, reproduced or distributed without prior written permission.


19. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use and protect personal information.


20. Force Majeure

IMPACKED will not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including natural disasters, pandemics, transport disruptions, government actions, supplier shortages or other unforeseen circumstances.


21. Changes to These Terms

IMPACKED may update these Terms of Service from time to time.

The most current version will always be published on our website, and continued use of our website or services constitutes acceptance of any updated Terms.


22. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising out of or relating to these Terms, our website or the supply of products or services shall be subject to the exclusive jurisdiction of the courts of Queensland.
